• Service refers to the SimuXAI platform, website accessible at https://simuxai.com, and all related tools, APIs, and applications.
• Account means a unique account created for You to access our Service or parts of our Service.
• Content refers to simulation configurations, input data, output results, and any other material uploaded, generated, or shared through the Service.
• Device means any device that can access the Service, such as a computer, cellphone, or digital tablet.
• You means the individual accessing or using the Service, or the company or legal entity on behalf of which such individual is using the Service.
• Simulation means any computational simulation created, configured, executed, or managed through the Service, including but not limited to CFD, Cantera, and OpenFOAM simulations.

2. Acknowledgment

These Terms govern your use of the SimuXAI platform and constitute the agreement between You and the Company. By accessing or using the Service, You agree to be bound by these Terms. If You disagree with any part of these Terms, You may not access the Service.

You represent that you are over the age of 18. The Company does not permit those under 18 to use the Service.

Your access to and use of the Service is also conditioned on Your acceptance of and compliance with our Privacy Policy.

3. User Accounts and Access

To use certain features of the Service, You must register for an Account. You agree to provide accurate, current, and complete information during the registration process and to keep Your Account information up to date.

• Upload malicious code, viruses, or any destructive content
• Abuse computational resources or attempt to circumvent usage quotas
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service for any purpose that is unlawful or prohibited by these Terms
• Interfere with or disrupt the integrity or performance of the Service

5. Intellectual Property

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of SimuXAI LLC and its licensors.

You retain ownership of Your simulation input data and configurations. Simulation results generated through the Service are owned by You, subject to any applicable third-party licenses for open-source simulation tools (e.g., OpenFOAM, Cantera).

6. Simulation Services

SimuXAI provides AI-driven simulation creation, execution, and visualization services. Simulation results are provided on an "as-is" basis and should be independently verified before being used for critical engineering decisions.

We do not guarantee the accuracy, completeness, or fitness of simulation results for any particular purpose. You are solely responsible for evaluating and validating simulation outputs.

Computational resources (core-hours, storage) are subject to the quotas and limits associated with Your Account and subscription plan.

7. Payment and Billing

Certain features of the Service may require payment. You agree to pay all fees associated with Your use of the Service in accordance with the pricing and payment terms presented to You at the time of purchase.

SimuXAI reserves the right to change pricing at any time. Changes will take effect at the start of Your next billing cycle, and We will provide reasonable notice of any pricing changes.

8. Links to Other Websites

Our Service may contain links to third-party websites or services that are not owned or controlled by SimuXAI. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites or services.

9. Termination

We may terminate or suspend Your Account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms. Upon termination, Your right to use the Service will cease immediately.

You may request deletion of Your Account and associated data by contacting Us at support@simuxai.com.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall SimuXAI, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of (or inability to use) the Service
• Any conduct or content of any third party on the Service
• Any simulation results or outputs generated through the Service
• Unauthorized access, use, or alteration of Your data

Our total liability shall not exceed the amount You have paid to SimuXAI in the twelve (12) months preceding the event giving rise to the claim, or $100 USD, whichever is greater.

11. "As Is" and "As Available" Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. SimuXAI does not warrant that the Service will be uninterrupted, secure, or error-free, or that results obtained from the Service will be accurate or reliable.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts located in Travis County, Texas.

13. Disputes Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting Us at support@simuxai.com.

14. Severability and Waiver

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish its objectives to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

The failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter.

15. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, We will provide at least 30 days' notice before the new terms take effect. By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised Terms.
